SIJS Deferred Action: Current Status and What Families Can Expect

Many families have recently reached out with questions about deferred action and work permits for youth who have been approved for Special Immigrant Juvenile Status (SIJS). This update reflects the situation as of November 20, 2025.

In June 2025, USCIS ended its long-standing policy of granting SIJS-based deferred action to youth with approved SIJS petitions who are waiting in the visa backlog. This change effectively eliminated the related path to work authorization for many young people.


This termination was challenged in a nationwide class action lawsuit, A.C.R. v. Noem. On November 19, 2025, the federal court issued an order that temporarily blocks the government’s 2025 policy of "rescission." However, the judge did not require USCIS to resume granting SIJS‑based deferred action or work permits at this time, so there is not yet a formal “deferred action is back” policy.


Practically speaking, USCIS has not yet issued new public guidance about how it will handle SIJS deferred action or related work authorization in light of the court’s order, so cases must still be evaluated individually. For families, this is a moment to stay informed, document eligibility carefully, and be ready to act quickly if new options open—rather than a time to lose hope.
